I have had my current Sprint number for about 1 year. Recently I have been getting calls for some guy named Adam. Seems like he doesn't return stuff to Blockbuster and has some people wanting to have meetings with him.

It happens about once a month.

However last night I got a call for him, told her that it wasn't his number and then a minute later my phone started ringing with an 800 number. I thought it was someone else for him, but I answered and it was some busy call center in another country and -with her bad english accent and grammar- began to tell me I have been picked to receive a free t-mobile phone etc. and to switch my number.

I told her "no thanks," and hung up, but then I thought I recalled that telemarketing calls to cell-phones, like that, were totally and completely illegal.

Isn't that the case? :eyebrow:

Thats correct. This was part of the telemarketing consumer protection act of 1991. The reasoning was that people must pay for cellphone use by the minute and you could not make any UNSOLICITED marketing calls that people must pay for.

However, it is possible that "ADAM" listed his cell number as his contact number with blockbuster - this opened the door for blockbuster to solicit / contact him using that number since they had his permission.

"Adam" (or someone elese) may have filed out a form (either willingly or not) and given other companies and their agents, affiliates, reps, etc permission to contact him at that (now your) cell number with offers and the like.

My advice would be to clearly state to the person calling that you want to be put on their do not call list.

I will do that. I know that blockbuster etc. calling for adam is legal, but my main question was that the tmobile telemarketing was DEFINATELY 100% illegal...

yeah I got telemarketors calling my cell all the time and ask me to refinance my house.. I tell them to take me off their calling list but they alwayws call back..

Anyway, everybody ought to put their cell number on the federal do-not-call list. Just go to http://www.donotcall.gov. - sheureka

Well you can put your cell phone number on the Do Not Call list.

I recently added both cell phones and my home number when I got tired of MCI trying to sell me long distance. Those idiots just dont understand the word NO!

Its worth a shot. And if they continue to call you after you tell them its a wrong number...complain to Sprint!

also, some states have a do not call list also, missouri has one here (http://www.ago.mo.gov/nocall/index.html).

an afiliate stopped by my work today to drop off some pricing sheets for me. with it, she always brings a printed page of little quips and quotes that are cute or something. this time along with that she also brought a page saying how you should go to some website to add you cell number to the do not call registry becuase it was recently 'announced' that telemarketing to cell phones would be legal. i wasn't too sure about that until i started reading this post, but i think i will be adding my number to that do not call list just in case. and do some research about that as well...

You probably got a number that was used by someone before as their only phone number and he listed that number as his "home" phone for everything. Now that number has been sold and re-sold to the marketing folks who have not done their due diligence in checking to see if it is a cell number.
