Ok, I am currently with a differenet carrier, but my contract is going to be up and I want to switch service to Sprint. My brothers friend is selling a Upstage phone, but I dont think the phone was actually his, I told him I was interested in the phone. He is giving me a really good price for everything....after reading some of the stories of not being able to activate a phone, I not too sure now.

Is there any way to check to see if there will or will not be any problems?

If I called sprint, would that pose any problems even though I am not a current user? My contract not going to be up for another couple of weeks, but seller says he really needs the $, if I dont buy it he needs to sell it on craigslist or ebay asap, he needs to fix his car, which is true.

Easy, grab the ESN of the phone, call Sprint CS (or go to a store) and find out if the ESN number is "clean" to use. It's basically like checking carfax for your phone.
