I was curious if new phones have a seal on the box. I am planning on purchasing the Touch off eBay and would like to know how to verify that the phone is brand new as described on the auction page.

depends really, but usually the phone will be taped inside a plastic bag, sometimes the boxes have a piece of tape holding them shut sometimes not, but usually the phone is taped inside a plastic bag, and you can always power on the phone and dial ##786# if the life timer is 0 you know it is unused.

BrettW is correct.

Easy way is to ask for the esn number from the person selling it and then call sprint to check and see if that esn has been activated before. That way you can make sure before buying the phone.
